Who these terms apply to

These terms apply to anyone engaging Harry Yelland, trading as Yelland Digital ("we", "us"), based in Norwich, UK, for website design, build, maintenance, hosting, or copywriting work. By confirming a quote or paying a deposit, you agree to these terms unless we've agreed something different with you in writing.

Quotes and payment

Quotes are based on the scope discussed at the time and are valid for 30 days unless stated otherwise. For new build projects, we typically ask for a deposit before work begins, with the balance due on completion, unless we've agreed a different schedule with you. Ongoing maintenance and hosting plans are billed on a rolling monthly basis. Late payment may result in work being paused until the account is settled.

Project scope and revisions

We'll agree the scope of a project with you before work begins. Reasonable rounds of revision are included as part of that scope; work that falls outside the agreed scope, or significant changes of direction partway through, may be quoted separately before we proceed.

Timescales

Any timescales we give are estimates, not guarantees. They depend on how quickly we receive the content, feedback, and approvals we need from you, and on the complexity of the work involved. We'll let you know as early as possible if something is likely to affect an agreed date.

Content and assets

Unless you've purchased our content and copy support service, you're responsible for providing the text, images, and other assets your site needs. You confirm that you own, or have the right to use, anything you supply to us, and that using it won't infringe anyone else's rights. We're not responsible for checking the accuracy or legality of content you provide.

Ownership and intellectual property

Once a project is paid for in full, ownership of the final website code and design produced for you transfers to you, and you're free to move it to another host or developer. Until full payment is received, the work remains our property. We may retain the right to display completed work in our own portfolio and case studies unless you ask us not to.

Cancellation

You can cancel a project at any point by telling us in writing. You'll be charged for work carried out up to that point, calculated on a fair and proportionate basis against the agreed scope, and any deposit paid may be used to cover this. For ongoing maintenance or hosting plans, either party can end the arrangement with 30 days' notice.

Hosting, domains, and third-party services

Where we manage hosting or a domain on your behalf as part of a maintenance plan, this continues only for as long as that plan is active. Where a project relies on third-party services, plugins, or platforms, we'll try to flag any ongoing costs associated with these, but you're responsible for any renewal or subscription fees charged directly by those providers.

Liability

We take reasonable care in everything we build and maintain, including backups and security updates where these form part of an agreed plan. However, we can't guarantee a website will be free of every fault, and we're not liable for indirect or consequential losses, such as lost profits or lost business, arising from its use. Nothing in these terms limits liability where it would be unlawful to do so.

Confidentiality

We treat information you share with us about your business as confidential, and we won't disclose it to third parties except where needed to deliver the work (for example, to a hosting provider) or where we're required to by law.

Governing law

These terms are governed by the law of England and Wales, and any disputes will be handled by the courts of England and Wales.

Changes to these terms

We may update these terms from time to time; the version in place when you confirm a project is the one that applies to it. We'll update the date at the top of this page whenever changes are made.
